TERMS AND CONDITIONS FOR TANGAMENTE:
 

COVID-19 SAFETY POLICY, LIABILITY WAIVER, RELEASE AND PRIVACY POLICY

 

By registering online or in person for the workshops and activities (collectively “Event” or “Events”) at TANGAMENTE hosted by TANGO INC. dba TANGAMENTE, I, the undersigned for myself (hereinafter “I” or “You”), agree to the following terms and conditions (“Terms and Conditions”) for in person participation of Events held from July 5, 2024 through July 7, 2024 at the San Francisco Russian Center 2460 Sutter St. San Francisco, CA

 

COVID-19 INFORMED CONSENT AND WAIVER: As a participant, You agree, understand and acknowledge, that there is an inherent risk of exposure to COVID-19.  Per the Centers of Disease Control and Prevention (“CDC”) and state and local laws and regulations, TANGAMENTE has health and safety protocols (COVID-19 Safety Policy) to reduce the spread of COVID-19. TANGAMENTE reserves the right to make all decisions and updates to the COVID-19 Policy, including but not limited to requiring additional COVID-19 testing, additional proof of vaccination or any other safety measures based on mandatory state and local requirements and/or the current situation at the time of TANGAMENTE.  You must comply with the updated protocols to the COVID-19 Policy for participation in any Event at TANGAMENTE. 

 

I fully understand that my participation in Events at TANGAMENTE exposes me to the risk of illness, personal injury, death and/or property damage. Knowing the risks, I hereby acknowledge that I am voluntarily participating in Events at TANGAMENTE where (i) I agree to comply with the COVID-19 Policy, and (ii) I assume those risks on behalf of myself to release and to hold harmless the released parties, which include (a) TANGAMENTE, (b) the property or site owner of the Activity, San Francisco Russian Center and (c) all past, present and future affiliates, successors, assigns, employees, volunteers, vendors, partners, directors, and officers, of such entities (subsections (a) through (c), collectively, the "Released Parties").  The Released Parties will not be responsible nor liable for any personal injury (including but not limited to illness and/or death), property damage, or other loss suffered as a result of your active or passive participation of any Event at TANGAMENTE, regardless if any such injuries or losses are caused by the negligence or carelessness of the Released Parties. 

 

GENERAL LIABILITY WAIVER AND RELEASE OF CLAIMS: You acknowledge the health risks and risk of injury associated with dancing, physical activity, and voluntary participation in the Events associated with TANGAMENTE, including but not limited to transient dizziness, lightheadedness, fainting, nausea, muscle cramping, musculoskeletal injury, joint pains, sprains and strains, heart attack, stroke, or sudden death. You understand that any injuries or outcomes that may arise from your own or other’s actions, inaction, or negligence, or the condition of the Event location(s) is done at your own risk and you have decided whether to consult with a health care provider based on your individual risk. 

 

I ACKNOWLEDGE AND ASSUME ANY AND ALL RELATED RISKS, BOTH KNOWN OR UNKNOWN TO ME, AND/OR MY PARTICIPATION IN ACTIVITY DURING TANGAMENTE. IN CONSIDERATION OF MY REGISTRATION FOR TANGAMENTE, I HEREBY WAIVE, RELEASE AND DISCHARGE ANY AND ALL LIABILITY, CLAIMS, AND ANY DEMANDS AGAINST THE RELEASED PARTIES, EITHER IN LAW OR IN EQUITY, TO THE FULLEST EXTENT PERMISSIBLE BY LAW, INCLUDING BUT NOT LIMITED TO DAMAGES OR LOSSES CAUSED BY THE NEGLIGENCE, FAULT OR CONDUCT OF ANY KIND ON THE PART OF THE RELEASED PARTIES, INCLUDING BUT NOT LIMITED TO ANY BODILY INJURY, ILLNESS, DEATH, PSYCHOLOGICAL INJURY (INCLUDING EMOTIONAL DISTRESS), ECONOMIC LOSS OR OUT OF POCKET EXPENSES (INCLUDING LEGAL FEES AND ATTORNEY FEES), OR LOSS OR DAMAGE TO PROPERTY, WHICH I, MY HEIRS, ASSIGNS, NEXT OF KIN AND/OR LEGALLY APPOINTED OR DESIGNATED REPRESENTATIVES, MAY HAVE OR WHICH MAY HEREINAFTER ACCRUE ON MY BEHALF, WHICH ARISE OR MAY HEREAFTER ARISE FROM MY PARTICIPATION IN EVENTS AT TANGAMENTE. 

 

PHOTOGRAPH AND VIDEO RELEASE: I understand that photographs, recordings and/or videos may be taken during TANGAMENTE, and hereby grant TANGAMENTE permission to use my image captured while participating in Events at TANGAMENTE. The photographs, recordings and/or videos may be used for TANGAMENTE promotional materials and publication, including posts on social media platforms. If for any reason you do not want your image used, please submit a request in writing to remove it from use.

PRIVACY POLICY: By registering online or in person for TANGAMENTE, I acknowledge and agree to terms and conditions of the Privacy Policy.

 

MISCELLANEOUS: The Terms and Conditions are written and to be interpreted as broad and inclusive as legally permitted under the governing laws of San Francisco County, California. If any portion of the Terms and Conditions are held invalid or unenforceable, such term or condition will be enforced to the maximum extent permissible to express its intended effect, where all other terms and/or conditions shall remain valid and continue in full force and effect. Any prior oral or written representations that may conflict with the Terms and Conditions shall not be valid and these Terms and Conditions shall prevail. Failure to enforce the Terms and Conditions will not constitute a waiver of a term nor condition. No amendment or additions to the Terms and Conditions shall be effective unless made in writing by an authorized representative of TANGAMENTE. 

 

I ATTEST THAT I AM AT LEAST 18 YEARS OF AGE, AND I HAVE READ, ACKNOWLEDGE AND AGREE TO THE TERMS AND CONDITIONS AND THE LEGAL CONSEQUENCES OF THE AGREEMENT OF THESE TERMS AND CONDITIONS, INCLUDING THE COVID-19 INFORMED CONSENT AND WAIVER, ASSUMPTION OF ALL RISKS ASSOCIATED WITH MY PARTICIPATION AT TANGAMENTE, WAIVE LIABILITY AND RELEASE OF ANY AND ALL CLAIMS AGAINST THE RELEASED PARTIES ARISING OUT OF OR IN CONNECTION IN ANY WAY TO MY PARTICIPATION IN TANGAMENTE, PRIVACY POLICY AND ADDITIONAL TERMS.

COLLECTION OF PERSONAL INFORMATION: Personal information may be collected or obtained by your online activity on our website, placing an order to register for the Event(s), and/or other third-party sources such as data providers and public sources that may include social media platforms, publications, and news sites. Personal information may include (i) contact data (such as first and last name, email address, billing and mailing address, and phone number), (ii) communications (such as exchanges regarding questions feedback, or otherwise), (iii) payment and transactional data (such as name, billing address, credit card information, and bank account information as provided to third party payment vendor), (iv) marketing data (such as communication preferences for engagement), and (v) other information which may not be collected that is not specifically listed here. Like many online services, the following technologies may be used to include cookies (such as information stored on your web browser), flash cookies (locally stored for large data amounts), web beacons (tracking information), and/or other such similar technologies to enable an enhanced experience online. If you choose, you may set your computer settings to view our website anonymously and/or refuse cookies.

HOW WE USE COLLECTED PERSONAL INFORMATION: Personal information collected may be used for the following purposes: (i) process transactions for registration and to place orders for services, (ii) provide customer service to respond to questions and feedback, (iii) communications, announcements, mailing lists and updates for upcoming events, support or security measures, (iv) personalization of your user experience, (v) enforcement of terms and conditions of the online service provided, (vi) improvements to online service and user experience, (vii) research and development purposes for data analytics to improve the user experience, (viii) compliance with applicable laws, lawful requests and legal process as required by government authorities, (ix) audit or internal process for compliance with legal and contractual requirements, and (x) prevention, identification, investigation and deterrence of fraudulent, unauthorized, unethical or illegal activity, including cyberattacks and identity theft. COMPLIANCE FOR CHILDREN'S ONLINE PRIVACY: Under the Children’s Online Privacy Protection Act, online services are not intended for use by children under 13 years of age. This website does not solicit, collect or manage any information from any known or suspected child under 13 years of age.

CHANGES TO PRIVACY POLICY: We reserve the right to modify this Privacy Policy at any time, effective upon posting online. Notification will be provided for any material changes to the Privacy Policy.

FOR CALIFORNIA RESIDENTS: Under the California Consumer Privacy Act of 2018, California residents have additional privacy rights, including but not limited to (i) requesting, accessing, and deleting the personal information collected and used during the past 12 months which does not disrupt the scope business conducted, and (ii) exercising your rights free from discrimination by emailing us.
